E-Bike Rental Agreement
& Liability Waiver

I fully understand and acknowledge that renting and operating an electric bicycle ("e-bike") involves serious inherent risks of injury or death. I voluntarily choose to participate and expressly assume all risks, including but not limited to:

• Serious injury or death resulting from falls, loss of control, or collisions
• Collisions with motor vehicles, cyclists, pedestrians, or stationary objects
• Hazardous road conditions common to historic St. Augustine: brick roads, cobblestones, narrow streets, uneven pavement, and loose surfaces
• Heavy tourist pedestrian traffic, unexpected crossings, and congested historic-district corridors
• Equipment malfunction, mechanical failure, or battery failure
• Adverse weather conditions including heat, humidity, rain, lightning, wind, and reduced visibility
• Higher speeds associated with electric-assist bicycles compared to conventional bicycles
• My own inexperience, inattention, fatigue, or errors in judgment
• The actions of third parties, pedestrians, tourists, and motor vehicle operators over whom St. Augustine E-Bike Rentals LLC has no control

I acknowledge that a properly fitted helmet has been offered and confirmed before the rental period begins. I agree to wear my helmet from the moment I mount the e-bike until I have completely dismounted and the bike is secured. St. Augustine E-Bike Rentals LLC staff may terminate my rental without refund if I am observed riding without a helmet.

No employee, contractor, or representative of St. Augustine E-Bike Rentals LLC may waive the helmet requirement. The rental may not begin until helmet fit has been confirmed by staff.

I acknowledge and confirm that before operating the e-bike I received a complete safety briefing from St. Augustine E-Bike Rentals LLC staff and had a full opportunity to ask questions, all of which were answered to my satisfaction before the rental began. The briefing covered:

• Starting, stopping, and powering the e-bike on and off
• Pedal assist levels and throttle operation (if applicable)
• Braking technique, brake locations, and stopping distances
• Speed control and safe operating speeds in different areas
• Parking, dismounting, and properly securing the e-bike
• Battery use, charging status, and recognizing low battery
• Locking the e-bike when left unattended
• Applicable traffic laws and local ordinances in St. Augustine
• Authorized riding areas, restricted areas, and pedestrian zones
• Emergency procedures and how to contact St. Augustine E-Bike Rentals LLC staff

I felt confident and capable of safely operating the e-bike before departing. I understand that if I was uncertain about any feature, it was my responsibility to ask before departing, and that St. Augustine E-Bike Rentals LLC is not liable for any injury or damage resulting from my failure to understand or follow proper operating procedures.

Before departing, I personally inspected the e-bike and all issued equipment. I agree that the e-bike and equipment were received in good, safe, and working condition except for any pre-existing damage specifically noted at time of rental. I agree to stop riding immediately and contact St. Augustine E-Bike Rentals LLC staff if I notice any problem with the brakes, tires, battery, throttle, pedal assist, steering, lights, chain, frame, or any other component.

I understand that continuing to ride after noticing a problem, or failing to report a problem promptly, increases my financial liability for any resulting damage.

• I am 18 years of age or older. No person under 18 may operate this e-bike.
• I hold a valid government-issued photo ID and am lawfully permitted to operate an e-bike.
• I will wear my helmet at ALL times — no exceptions (Section 2).
• I will obey all applicable federal, state, and local traffic laws at all times.
• I will NOT allow any other person to operate the e-bike assigned to me — see Section 5B.
• No passengers of any kind are permitted — one rider only — see Section 5B.
• I will NOT modify, tamper with, or attempt to repair any component of the e-bike.
• I will lock the e-bike using the provided lock whenever it is left unattended.
• I will return the e-bike to St. Augustine E-Bike Rentals LLC staff at the designated return location at the agreed time.
• I will immediately contact staff in the event of any accident, collision, injury, mechanical issue, or damage.

• I will wear closed-toe shoes at all times while operating the e-bike.
• I will NOT use headphones, earbuds, handheld phones, cameras, or any other distracting device while riding.
• I will NOT ride after sunset, before sunrise, or in low-visibility conditions unless expressly authorized by St. Augustine E-Bike Rentals LLC and the e-bike is equipped with legally required lights.
• I will NOT carry more cargo than the e-bike's rated capacity and will secure all cargo properly before riding.

• I will NOT ride on sidewalks, pedestrian-only areas, beaches, dunes, private property, restricted parks, seawalls, stairs, or ramps, or any area where e-bikes are prohibited by law or posted sign.
• I will walk the e-bike through crowded pedestrian areas, the historic district, and narrow passages.
• I will obey all posted signs, St. Augustine historic district rules, and applicable city ordinances.
• I understand that brick roads, cobblestones, narrow streets, and heavy tourist foot traffic in historic St. Augustine present additional hazards that I accept sole responsibility for navigating safely.

• I will NOT ride through standing water, flooded streets, saltwater, beach sand, deep puddles, or during heavy rain, lightning, or unsafe weather conditions.
• I understand that water, salt, and sand can cause serious and expensive damage to the e-bike and battery, and I am financially responsible for any such damage occurring during my rental.
• I will stop riding and contact staff immediately if weather conditions become unsafe.

• I will NOT remove, open, tamper with, charge, submerge, puncture, expose to excessive heat, or otherwise misuse the battery or any electrical component of the e-bike.
• I will immediately stop riding and contact staff if the battery, motor, display, wiring, or charger appears damaged, overheated, smoking, swollen, leaking, sparking, or malfunctioning.
• Battery damage caused by misuse, immersion, impact, or improper storage is my full financial responsibility.

• I know how to ride a bicycle and can safely balance, steer, brake, and control an e-bike in traffic and public areas.
• I am physically and mentally capable of safely operating the e-bike for the full duration of my rental.
• I meet the minimum height and fit requirements and do not exceed the manufacturer's maximum rider weight limit.

No employee, contractor, or representative of St. Augustine E-Bike Rentals LLC may waive helmet use, safety rules, age requirements, return requirements, payment obligations, or financial responsibility on behalf of St. Augustine E-Bike Rentals LLC unless approved in writing by an authorized owner or manager. Verbal assurances or permissions from staff do not override this Agreement.

• I will NOT, under any circumstances, allow any other person — including a friend, family member, travel companion, or spouse — to operate or ride this e-bike.
• Any person who has not personally signed a completed St. Augustine E-Bike Rentals LLC Rental Agreement and Liability Waiver is an unauthorized operator and is strictly prohibited from riding this e-bike.
• If I allow another person to operate this e-bike, I am in material breach of this Agreement and my rental may be terminated immediately without refund.
• I remain fully financially responsible for any damage, loss, injury, or theft caused by any unauthorized person I allowed to operate the e-bike, regardless of whether that person is with me at the time.

• No passenger, child, adult, or any other person may ride on or be carried by this e-bike at any time.
• No child seat, rear rack rider, front basket rider, or any attachment designed or used to carry an additional person is permitted.
• No person may hold onto or be towed by this e-bike while I am riding it.
• Carrying a passenger or additional rider of any kind is a material breach of this Agreement and creates dangerous riding conditions for which I am solely responsible.

• If I allow another person to operate this e-bike without authorization, I remain personally and fully liable for all damage, theft, loss, injury, and legal consequences arising from that unauthorized person's use of the e-bike.
• The unauthorized operator has not signed a waiver and has no legal relationship with St. Augustine E-Bike Rentals LLC. Any claim or injury involving an unauthorized operator is solely my responsibility as the renter of record.
• I will indemnify, defend, and hold harmless St. Augustine E-Bike Rentals LLC from any claim, lawsuit, cost, or expense arising from or related to any unauthorized person's use of this e-bike during my rental period.
• St. Augustine E-Bike Rentals LLC expressly disclaims all liability for any injury, death, or property damage suffered by or caused by an unauthorized operator or passenger. I waive any claim against St. Augustine E-Bike Rentals LLC arising from such use on behalf of myself and any such unauthorized operator or passenger, to the fullest extent permitted by law.

I represent and warrant that I am NOT operating and will NOT operate the e-bike while affected by any of the following:

• Alcohol of any amount
• Cannabis, CBD products with impairing effects, or any cannabis-derived substance
• Illegal drugs or controlled substances
• Prescription medication that may impair alertness, coordination, reaction time, balance, or judgment
• Over-the-counter medication, antihistamines, sleep aids, or any substance that causes drowsiness or impairment
• Fatigue, sleep deprivation, dizziness, illness, nausea, or any physical or mental condition that could affect my ability to ride safely

Operating an e-bike while impaired is illegal, extremely dangerous, and a material breach of this Agreement. I accept full and sole responsibility for any injury, damage, or legal consequences resulting from riding while impaired. St. Augustine E-Bike Rentals LLC staff may refuse to release or may immediately terminate the rental of any renter who appears impaired, without refund.

I accept complete, unconditional, and personal financial responsibility for the e-bike and all equipment assigned to me for the entire rental period. My liability is NOT limited to the security deposit amount.

• DAMAGE: If the e-bike or any equipment is damaged for any reason during my rental — including accident, collision, fall, weather, water, salt, sand, or misuse — I am personally responsible for 100% of all repair costs as assessed by St. Augustine E-Bike Rentals LLC or its designated service provider.
• TOTAL LOSS / BEYOND REPAIR: If the e-bike is damaged beyond reasonable repair, I am personally responsible for the full replacement cost of a brand-new equivalent e-bike at current retail price.
• THEFT OR LOSS: If the e-bike is lost or stolen while in my care — regardless of whether I used the provided lock — I am personally responsible for the full replacement cost of a brand-new equivalent e-bike.
• REPLACEMENT AT NEW VALUE: Damaged, lost, or stolen equipment shall be valued at its full new replacement cost, not its depreciated value, unless otherwise agreed in writing by St. Augustine E-Bike Rentals LLC.
• ACCESSORIES: I am responsible for all issued accessories including helmet, lock, charger, basket, and any other equipment. Loss or damage to accessories is charged at full replacement cost.
• FINES AND CITATIONS: I am solely responsible for all traffic citations, parking violations, tolls, and legal penalties incurred during the rental period.
• NON-RETURN: If the e-bike is not returned by the agreed time, late fees accrue immediately. See Section 8.

Actual replacement charges will be based on current manufacturer or authorized dealer pricing at the time of the incident.

I authorize St. Augustine E-Bike Rentals LLC to securely store or tokenize my payment method through its payment processor and to charge that payment method for any and all amounts owed under this Agreement, including but not limited to:

• Rental fees, rental extensions, and late-return fees
• Damage repair costs or full replacement value of the e-bike or any accessory
• Theft, loss, or non-return replacement value
• Missing accessories (helmet, lock, charger, basket, etc.)
• Recovery, retrieval, or repossession fees
• Traffic citations, parking fines, tolls, or other governmental charges incurred during the rental
• Collection costs, court costs, and attorney's fees if required to recover unpaid amounts

• My security deposit is NOT the limit of my liability. I may owe amounts that exceed the deposit.
• Charges may be processed after the rental period ends if damage, loss, non-return, citations, or other amounts are discovered or assessed later.
• I agree NOT to initiate a chargeback for any valid charge made under this Agreement. If I initiate a chargeback for a valid charge, I agree to provide truthful information to my card issuer and remain personally responsible for all amounts owed plus any chargeback-related fees.

The e-bike must be physically returned to and accepted by St. Augustine E-Bike Rentals LLC staff at the designated return location by the agreed return time. The following do NOT constitute a valid return:

• Leaving the e-bike unattended outside the rental location
• Locking the e-bike to a public rack, sign, pole, fence, or any object not designated by St. Augustine E-Bike Rentals LLC
• Leaving the e-bike at a hotel, restaurant, beach access, or any location not designated by St. Augustine E-Bike Rentals LLC
• Sending another person to return the e-bike without prior written authorization

An alternate drop-off location requires prior written approval from an authorized manager of St. Augustine E-Bike Rentals LLC. Verbal staff approvals for alternate returns are not valid.

If the e-bike is not returned by the agreed return time and I fail to respond to St. Augustine E-Bike Rentals LLC's reasonable attempts to contact me:

• Late fees begin accruing immediately: $25 per 15 minutes or $75 per hour, whichever is greater
• After two (2) hours past the agreed return time without contact, the e-bike may be treated as unlawfully retained
• St. Augustine E-Bike Rentals LLC may charge the full replacement value plus a recovery fee (minimum $100, or $200+ after hours) to the payment method on file
• St. Augustine E-Bike Rentals LLC may report the matter to the St. Johns County Sheriff's Office or St. Augustine Police Department as a theft or unlawful retention of property. I agree this is authorized by this Agreement and does not constitute wrongful legal process.

I authorize St. Augustine E-Bike Rentals LLC to photograph or scan my government-issued photo ID for identity verification, fraud prevention, damage documentation, and law-enforcement or insurance purposes if needed. I understand that St. Augustine E-Bike Rentals LLC will not photograph, store, or retain my full credit card number. Documentation may include:

• Photograph or scan of government-issued photo ID
• Payment confirmation record (last 4 digits only — no full card numbers stored)
• Photos of the renter with the assigned e-bike at checkout
• Photos of e-bike condition at checkout and return
• This signed Rental Agreement and Waiver

The e-bike may contain GPS, Bluetooth, cellular, AirTag, or other tracking technology for theft prevention, fleet recovery, and safety monitoring purposes. I agree to:

• NOT remove, disable, block, tamper with, cover, destroy, or interfere with any tracking device or technology on the e-bike
• Acknowledge that the location of the e-bike may be monitored during the rental period
• Acknowledge that location data may be shared with law enforcement in the event of theft, non-return, or an emergency

In consideration of being permitted to rent an e-bike from St. Augustine E-Bike Rentals LLC, I, on behalf of myself, my heirs, personal representatives, assigns, executors, and next of kin (collectively, "Releasors"), HEREBY VOLUNTARILY, KNOWINGLY, AND IRREVOCABLY:

I acknowledge that this Release was a material inducement for St. Augustine E-Bike Rentals LLC to permit me to rent the e-bike, and that the Released Parties would not have allowed me to rent the e-bike without my agreement to this Release and Waiver.

I agree to DEFEND, INDEMNIFY, and HOLD HARMLESS the Released Parties from any and all claims, lawsuits, demands, losses, damages, costs, and expenses (including reasonable attorney's fees and court costs) brought by any third party arising out of or related to: (a) my use or misuse of the e-bike; (b) my violation of this Agreement; (c) my violation of any applicable law or regulation; or (d) any injury, death, or property damage I cause to any third party while operating the e-bike. If I fail to pay amounts owed under this Agreement, I agree to pay all reasonable collection costs, court costs, and attorney's fees incurred by St. Augustine E-Bike Rentals LLC to recover such amounts, to the fullest extent permitted by law.

St. Augustine E-Bike Rentals LLC does NOT provide health insurance, accident insurance, liability insurance, automobile insurance, or personal property insurance of any kind for renters or operators. I am solely responsible for obtaining and maintaining my own insurance coverage. I should not assume that any insurance carried by St. Augustine E-Bike Rentals LLC covers me, my injuries, my property, or claims made against me by third parties.

St. Augustine E-Bike Rentals LLC is NOT responsible for any loss, theft, or damage to my personal belongings during the rental period, including but not limited to: phone, wallet, keys, glasses, sunglasses, bags, clothing, camera, or any other personal item carried during the rental.

I represent and warrant that I am in good physical and mental health, have no medical condition, disability, or physical impairment that would prevent me from safely operating an e-bike, and am physically capable of riding in traffic and public areas. In the event of a medical emergency arising from my rental, I authorize St. Augustine E-Bike Rentals LLC staff to seek emergency medical assistance on my behalf. I accept sole financial responsibility for all medical treatment costs incurred.

This Agreement constitutes the entire agreement between the renter and St. Augustine E-Bike Rentals LLC regarding the subject matter herein. The renter is NOT relying on any oral statement, promise, advertisement, representation, or assurance made by any employee or agent of St. Augustine E-Bike Rentals LLC that is not expressly written in this Agreement.

Any modification of this Agreement must be in writing and signed by an authorized representative of St. Augustine E-Bike Rentals LLC. No employee, contractor, or representative may modify this Agreement verbally. This Agreement supersedes all prior understandings, discussions, and agreements between the parties.
