Age Requirement I am 18 years of age or older and will be the person operating the assigned e-bike. No person under 18 may operate a rental e-bike. Misrepresenting age may void the agreement and prevent the rental from beginning. Section 1 — Assumption of Risk I understand riding an e-bike has risks and I accept those risks. E-bike riding can involve falls, collisions, uneven streets, traffic, pedestrians, weather, equipment issues, and other hazards common around historic St. Augustine. Section 2 — Mandatory Helmet Requirement I agree to wear a helmet at all times while riding. Helmet use is mandatory from the moment you mount the e-bike until you fully dismount and secure it. Removing your helmet may end the rental without refund. Section 3 — Pre-Ride Safety Briefing I understand I must receive the safety briefing before riding. Before departure, staff will review starting, stopping, braking, pedal assist, speed control, battery use, locking, local rules, restricted areas, and emergency procedures. Section 4 — Equipment Inspection I will inspect the e-bike and report any issue before or during the ride. You agree the bike is received in good working condition except for any pre-existing damage noted before departure. Stop riding and contact staff if anything feels unsafe. Section 5 — Rules and Conditions of Operation I agree to follow all rules of operation. This includes obeying traffic laws, wearing closed-toe shoes, not using phones or headphones while riding, avoiding restricted areas, avoiding unsafe weather, and returning the bike to staff on time. Section 5B — No Unauthorized Riders / No Passengers I will not allow another person to operate my assigned e-bike, and I will not carry passengers. Only the person who signs this waiver may operate the assigned e-bike. No passengers, second riders, child seats, towing, or unauthorized riders are allowed. Section 6 — No Impairment I will not ride while impaired by alcohol, drugs, medication, fatigue, or any unsafe condition. You confirm you are physically and mentally able to ride safely and are not affected by anything that could reduce balance, reaction time, judgment, or awareness. Section 7 — Financial Responsibility I accept financial responsibility for damage, loss, theft, late return, and missing equipment as described in the rental agreement. You may be responsible for repair costs, full replacement value, lost accessories, late fees, recovery fees, citations, tolls, and other costs connected to your rental. Section 8 — Payment Authorization / Return Policy I understand additional valid charges may be processed through the payment provider after the rental if needed. Payment is handled through the payment processor, not this form. Valid post-rental charges may include late return, damage, loss, theft, recovery, missing accessories, or other amounts owed under the agreement. Section 9 — Photo ID / GPS Tracking Disclosure I understand the e-bike may contain GPS or other tracking technology for safety and theft prevention. The bike may contain GPS, Bluetooth, cellular, AirTag, or similar tracking technology. Do not remove, disable, cover, block, or tamper with any tracking device. Section 10 — Release of Liability / Covenant Not to Sue I understand I am releasing claims and agreeing not to sue as described in the full waiver. The waiver includes a release of liability, waiver of claims, and covenant not to sue, including claims related to ordinary negligence to the fullest extent permitted by Florida law. Section 11 — No Insurance Provided I understand St. Augustine E-Bike Rentals does not provide insurance for me, my property, or my ride. You are responsible for your own health, accident, liability, automobile, personal property, and other insurance coverage. Section 14 — Entire Agreement / No Oral Promises I understand this written agreement controls the rental. The written rental agreement is the entire agreement. Verbal statements, promises, ads, or employee comments do not change the terms unless approved in writing by an authorized owner or manager. Reservation Matching I understand this waiver must match the correct group reservation name and rental date. If the reservation name or date is entered incorrectly, staff may not be able to match this waiver to the rental request. Full Waiver Review I understand I must review the full Rental Agreement & Waiver before signing and submitting this rider waiver. The short summaries above do not replace the full waiver. You must open and review the complete agreement before submitting your electronic signature.
